Terms of Use

1. Acceptance of Terms

By accessing or using Tuluva.in (“the Platform”, “we”, “us”, “our”), you (“User”, “you”) agree to be bound by these Terms of Use (“Terms”). If you do not agree with these Terms, please do not use this Platform.

These Terms constitute a legally binding agreement between you and Tuluva.in, governed by the laws of India, including the Information Technology Act, 2000 and the Consumer Protection Act, 2019.

2. About the Platform

Tuluva.in is an online local business directory serving the Udupi, Mangalore (Dakshina Kannada), and Kasaragod districts of the Tulunadu region of coastal Karnataka. The Platform allows:

  • Visitors to search and discover local businesses, services, and events
  • Business Owners to create, claim, and manage their business listings
  • Registered Users to save, review, and engage with listings

Tuluva.in is a directory and information platform only. Listing a business on Tuluva.in does not constitute an endorsement, recommendation, or guarantee of the quality of any product, service, or business listed.

3. User Accounts

3.1 Registration

To list a business or access certain features, you must register for an account by providing accurate and complete information. You are responsible for maintaining the confidentiality of your login credentials.

3.2 Account Responsibility

You are solely responsible for all activity that occurs under your account. You must notify us immediately at hello@tuluva.in if you suspect any unauthorised use of your account.

3.3 Account Termination

We reserve the right to suspend or permanently terminate accounts that violate these Terms, without prior notice.

4. Business Listings

4.1 Accuracy of Information

Business owners are solely responsible for the accuracy, completeness, and timeliness of information submitted for their listing. Tuluva.in does not verify the accuracy of listing content and is not liable for any errors, omissions, or outdated information.

4.2 Listing Approval

All submitted listings are subject to review and approval by the Tuluva.in team. We reserve the right to reject, modify, or remove any listing at our sole discretion, including listings that:

  • Contain false, misleading, or deceptive information
  • Violate any applicable law or regulation
  • Include offensive, defamatory, or harmful content
  • Are duplicates of existing listings
  • Belong to categories not covered by the directory

4.3 Listing Content

By submitting a listing, you grant Tuluva.in a non-exclusive, royalty-free, worldwide licence to display, reproduce, and distribute the submitted content (text, images, logo, etc.) on the Platform and in promotional materials for Tuluva.in.

4.4 Prohibited Content

You must not submit listings or content that:

  • Is false, misleading, or fraudulent
  • Infringes any intellectual property rights
  • Contains adult content, hate speech, or promotes illegal activity
  • Impersonates another business or individual
  • Violates any law in India or applicable jurisdiction

5. User Conduct

You must not submit listings or content that:

  • Use the Platform for any illegal or unauthorised purpose
  • Scrape, harvest, or systematically collect data from Tuluva.in without written permission
  • Attempt to gain unauthorised access to any part of the Platform
  • Upload or transmit viruses, malware, or other harmful code
  • Post spam, unsolicited messages, or promotional content in reviews or comments
  • Manipulate ratings, reviews, or listing rankings

6. Reviews and User-Generated Content

If Tuluva.in enables user reviews or comments, you agree that:

  • Your reviews and comments reflect your genuine personal experience
  • You will not post fake, defamatory, or commercially motivated reviews
  • You grant Tuluva.in the right to display, moderate, or remove your review at any time
  • Tuluva.in is not liable for any content posted by users

We reserve the right to remove any review or comment that violates these Terms or is reported as abusive.

7. Intellectual Property

All content on Tuluva.in — including the name “Tuluva”, the website design, logo, graphics, database structure, written content, and code — is the property of Tuluva.in and is protected under applicable intellectual property laws.

You may not reproduce, republish, distribute, or commercially exploit any part of Tuluva.in without prior written consent.

8. Disclaimers

  • Tuluva.in is provided on an "as is" and "as available" basis without warranties of any kind.
  • We do not guarantee that the Platform will be uninterrupted, error-free, or free from viruses.
  • We do not endorse, verify, or vouch for any business listed on the Platform.
  • Any transaction you undertake with a listed business is solely between you and that business. Tuluva.in bears no responsibility for the outcome of such transactions.

9. Limitation of Liability

To the fullest extent permitted by Indian law, Tuluva.in, its directors, employees, and affiliates shall not be liable for:

  • Any indirect, incidental, special, or consequential damages
  • Loss of profits, data, or business opportunities
  • Damages arising from reliance on information provided by business listings
  • Any dispute between a user and a listed business

Our total cumulative liability, if any, shall not exceed the amount paid by you to Tuluva.in in the three (3) months preceding the claim.

10. Third-Party Links and Services

Tuluva.in may contain links to third-party websites or services. We are not responsible for the content, accuracy, or practices of those sites. Accessing third-party links is at your own risk.

11. Modifications to the Platform

We reserve the right to modify, suspend, or discontinue any part of Tuluva.in at any time, with or without notice. We will not be liable to you or any third party for any such changes.

12. Governing Law and Dispute Resolution

These Terms are governed by and construed in accordance with the laws of India. Any dispute arising from or related to these Terms shall be subject to the exclusive jurisdiction of the courts located in Udupi, Karnataka, India.

In the event of a dispute, parties shall first attempt to resolve the matter amicably through good-faith negotiation within 30 days. If unresolved, the dispute may be referred to arbitration under the Arbitration and Conciliation Act, 1996, with proceedings in English or Kannada at the discretion of the arbitrator.

13. Changes to Terms

We may revise these Terms at any time. The updated Terms will be posted on this page with a revised date. Your continued use of Tuluva.in after such changes constitutes your acceptance of the new Terms.
